Terms of service.
The agreement between DAY/OS and a mountain that uses it. Plain words where we can.
Last updated October 16, 2026.
1. The agreement
These terms apply when a ski area or other business ("you", the mountain) uses DAY/OS. The person who accepts them for the mountain confirms they may do so. A separate written agreement signed by both of us takes priority over these terms where they differ.
2. Trials and demos
A free trial lasts 14 days with every app on. A demo mountain is for trying DAY/OS with made-up data; it sends no email, takes no payments and is deleted when it ends. Trials and demos are provided as they are, without the commitments in section 8.
3. Subscriptions and payment
- You choose a plan, any add-ons, and monthly or yearly billing on the Billing page. Prices are those shown there, in US dollars, plus any tax that applies.
- Card and bank account subscriptions renew automatically at the start of each period. Invoices are due 30 days after they are issued.
- Changing plans or add-ons part way through a period is charged or credited for the time left, through Stripe.
- You can cancel at any time from the Billing page. You keep access until the end of the period already paid. We do not refund part periods, except where the law requires it.
- We may change prices with at least 30 days' notice by email to the owner. A change applies from your next period.
4. Late payment
If a payment fails or is late, everything keeps working for 14 days and we tell the owner. After that the mountain becomes read only until it is paid: people can sign in, see and export everything, and patrol, the time clock and the team Inbox keep working, but nothing new is sold, booked or added. Paying restores everything straight away.
5. Your data
- Everything you put into DAY/OS is yours. You give us permission to store and process it only to provide DAY/OS to you.
- You can export your records at any time. If you leave, you have 60 days to export before we delete them, unless the law requires us to keep something.
- You are responsible for having the right to record what you record, including consent from guests for marketing messages, and for meeting the rules that apply to you, such as those for patient records and employee hours.
- We handle personal information as our privacy policy says.
6. Using DAY/OS properly
- Keep logins to the people they belong to, and tell us if you think one has been misused.
- Do not try to reach another mountain's data, break the service, or use it to send messages people did not agree to receive.
- We may pause a mountain that puts the service or others at risk, and will tell the owner why.
7. Patrol and safety
DAY/OS helps your people record and coordinate what they do. It does not replace their training, your medical director's protocols, radios, or calling 911. Take-home sheets, sample waivers and checklists are starting points for you and your advisers to review, not medical or legal advice. Phone alerts depend on phones, networks and settings outside our control; do not rely on them as the only way to reach a responder.
8. What we commit to
- We run DAY/OS with care, back up your data daily, and fix problems promptly.
- We tell you about changes that affect how you work before they happen, and list every change in What's new.
- We tell you without delay if we learn that your data has been reached by someone who should not have it.
9. Limits
Apart from the commitments above, DAY/OS is provided as it is, and we do not promise it will be free of every error or never unavailable. To the extent the law allows, neither of us is liable to the other for indirect or lost-profit damages, and our total liability for any claim is limited to what you paid us in the 12 months before it. These limits do not apply to amounts you owe us, or to either side's fraud or willful misconduct.
10. Changes to these terms
We may update these terms. We will email the owner at least 30 days before a change that reduces your rights takes effect. Continuing to use DAY/OS after that means you accept the change; if you do not, you can cancel.
11. Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, and disputes are heard in its courts, unless the law where you are says otherwise.
12. Contact
Questions about these terms: write to us through the Contact page.
